Terms of Service

Last updated October 20, 2026. These Terms cover SongSpinnerZ.com, AboutTheEx.com, the SongSpinnerZ YouTube channel and our emails (together, the "Service"), operated by SongSpinnerZ ("we", "us"), based in Florida, USA.

Plain-English summary: you must be 18+. Only send us stories, lyrics, melodies and photos that are yours to share. Don't use a song to harass, threaten or expose anyone. Use first names only. We may publish your song on YouTube and our sites. If someone sues over what you sent us, you are responsible. Disputes go to individual arbitration under Florida law. The full terms below control.

1. Who can use the Service

You must be at least 18 years old and able to form a binding contract. By submitting an order, ticking the consent boxes, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.

2. The service

We write and produce custom songs, lyric videos and related content ("Songs") based on what you send us, using our own creative process and software tools, including generative AI. Songs are currently free for a limited time. We may change, pause or stop the Service at any time. Results are creative and subjective; a Song may not match your expectations.

3. What you send us ("Your Submissions")

Your Submissions include your story, names, inside jokes, photos, lyrics, melodies, voice or humming recordings, notes and anything else you provide.

License to us. You keep ownership of Your Submissions. You grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable and sublicensable license to use, copy, edit, adapt, translate, arrange, set to music, perform, record, publish, distribute and display Your Submissions, in whole or part, in any media now known or later developed, to create, publish, promote and operate the Service and the Songs. You waive any "moral rights" in Your Submissions to the extent permitted by law.

4. Your promises (warranties)

For everything you submit, you promise that:

• You wrote it, own it, or have written permission to share it and to grant the license above. Any lyrics or melody you provide are original to you and are not copied from, or substantially similar to, any existing song.
• Statements of fact about real people are true. Anything that is not true is clearly opinion, exaggeration or a joke that no reasonable listener would take as a statement of fact.
• You have the right to identify any person you mention, and, where needed, they have agreed; or the use is not defamatory, does not invade anyone's privacy, and does not use anyone's name or likeness for advertising or commercial endorsement.
• You have not included private or identifying information about anyone (last names, addresses, phone numbers, workplaces, schools, social handles, license plates, medical, financial or sexual details).
• Your Submissions and your use of the Song comply with all laws.

5. First names only

Songs, titles, descriptions and videos use first names only for anyone mentioned. We remove last names and identifying details, and we may change names or details at our discretion.

6. Content rules

You may not use the Service to create or request content that:

• harasses, bullies, intimidates, stalks or threatens anyone, or is intended to cause someone substantial emotional distress;
• reveals someone's private or identifying information ("doxxing") or encourages anyone to contact, find or harm a person;
• is defamatory, or falsely accuses anyone of a crime, disease, sexual conduct or professional misconduct;
• involves minors in any sexual, romantic or demeaning way, or names or targets a minor (family-friendly birthday-style songs for a child, requested by a parent or guardian, are allowed);
• is sexually explicit (swearing is OK when you choose "Explicit lyrics");
• promotes hate or violence based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age or veteran status;
• impersonates anyone, imitates a real artist's voice, or copies existing songs or lyrics;
• violates any law or anyone's rights, including copyright, trademark, privacy and publicity rights.

7. Our right to refuse, edit or remove

We may refuse any order, change any lyric, name or detail, decline to publish, or remove any Song, video or comment at any time, for any reason or no reason, without notice or liability. We do not pre-approve or endorse any Submission and we are not responsible for user-provided statements.

8. Copyright screening

If you upload lyrics or a recording, you agree we (and third-party screening providers acting for us) may compare them against databases of existing music and lyrics. A screening result is not a legal opinion; a "no match" result does not mean a Submission is original. We may change or reject anything that appears to match an existing work.

9. Publishing on YouTube and our sites

Unless we agree otherwise in writing, you agree that we may publish your Song and lyric video on the SongSpinnerZ YouTube channel, SongSpinnerZ.com, AboutTheEx.com and our social channels, and use clips to promote the Service. You can ask us to keep your name off the video (tick "Keep me anonymous"). Opting out of public posting: email orders@songspinnerz.com with your order ID and we will review your request; while songs are free, public posting is part of the offer, so we may decline to make a Song private-only, in which case you may cancel the order. Anyone named or featured in a Song may ask us to review or remove it using the contact below.

10. Ownership of Songs and your license

Songs are created with the help of generative AI tools. Under current U.S. Copyright Office guidance, material generated purely by AI may not be protected by copyright, while human-authored contributions (such as human-written lyrics and creative selection, arrangement or modification) may be. As between you and us, and to the fullest extent permitted by law, we own and retain all rights, title and interest in the Songs (including lyrics, music, recordings, arrangements and videos we create), except Your Submissions, which remain yours under section 3.

Your license. Once a Song is delivered, we grant you a worldwide, non-exclusive, royalty-free, perpetual license to download, copy, play, perform, share and post the Song anywhere, including social media and video platforms, for personal, non-commercial purposes. You may not sell or license the Song, register it with a content-ID or royalty system, claim you exclusively own it, or use it in paid advertising or broadcast without our written permission. Because AI-generated material may not be copyrightable, we cannot promise that you or we can stop others from copying a Song.

11. Copyright complaints (DMCA)

We respect copyright and respond to notices under the Digital Millennium Copyright Act, 17 U.S.C. § 512. To report material on our sites that you believe infringes your copyright, send our designated agent a written notice that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the material and where it appears (URL); (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized by the owner, its agent or the law; and (6) a statement, under penalty of perjury, that the notice is accurate and you are authorized to act for the owner.

If your material was removed and you believe it was a mistake, you may send a counter-notice that meets 17 U.S.C. § 512(g)(3). We will terminate repeat infringers in appropriate circumstances. Content on YouTube is also subject to YouTube's own copyright process.

12. Voice and audio recordings

If you record yourself singing or humming, we use the recording only as a creative guide and for copyright screening. We do not create voiceprints or use recordings to identify you, we never sell them, and we delete them within 90 days after delivery or on request. Only record your own voice, and don't record other people without their consent.

13. Indemnity (hold harmless)

You will defend, indemnify and hold harmless SongSpinnerZ and its owners, contractors and service providers from any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or related to Your Submissions, your use of the Service or a Song, your breach of these Terms, or your violation of any law or anyone's rights (including claims of defamation, invasion of privacy, right of publicity, harassment or copyright infringement).

14. Disclaimer of warranties

THE SERVICE AND ALL SONGS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not guarantee delivery times, that a Song will meet your expectations, or that a Song is free of similarity to other works.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE ORDER AT ISSUE OR US$50. Some jurisdictions don't allow certain limitations, so some may not apply to you.

16. Payments and refunds (when paid orders begin)

Prices, including any upcharges for custom lyrics or melodies, will be shown clearly before you pay, and payments will be processed by our payment provider (e.g., Stripe). Because each Song is custom-made, payments are non-refundable once production starts, except: if we fail to deliver, cancel or refuse your order, or you cancel before production starts, you get a full refund; and any refund required by law will be given. We will not charge recurring fees without your express consent. Free orders submitted before paid pricing launches stay free.

16A. Future voice features

We may later offer optional upgrades that use technology to create a version of a song sung in a voice modeled on your own. These features are not available yet. If offered, they will be optional, will require your separate express consent, may be used only with your own voice recorded by you (never another person's voice), and will be governed by additional terms shown before purchase.

17. Dispute resolution: arbitration and class-action waiver

Please read carefully. This affects your rights. Before filing a claim, you agree to email orders@songspinnerz.com and try to resolve it informally for 30 days. Any unresolved dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, under the Federal Arbitration Act. The arbitration will take place in [COUNTY], Florida, or by video, or in your home county if the AAA rules require. Either party may instead bring an individual claim in small claims court. You and we waive any right to a jury trial and to participate in a class, collective or representative action. You may opt out of this arbitration section by emailing us within 30 days of first accepting these Terms. If the class waiver is found unenforceable, this section (other than the small-claims option) is void.

18. Governing law and venue

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to section 17, exclusive venue is the state and federal courts located in [COUNTY], Florida.

19. Other terms

We may update these Terms by posting a new version with a new date; changes apply to orders placed after that date. If any part is unenforceable, the rest stays in effect. These Terms, plus the Privacy Policy, are the entire agreement between us. Our failure to enforce a term is not a waiver. You may not assign these Terms; we may.
